Terms of Service

Last updated: October 9, 2026

These Terms of Service ("Terms") govern your access to and use of GearTrain (the "Service"), operated by Robert William Narvaez, based in Switzerland ("GearTrain", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree with any part of them, you must not use the Service.

These Terms include our Privacy Policy and any additional policies we reference.

Accounts

You must be at least 16 years old and have the legal capacity to enter into these Terms, and you must not be barred from using the Service under applicable law. You must provide accurate, complete, and current information when you create an account, and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Do not share your account or let anyone else use it. Notify us promptly at [email protected] if you suspect any unauthorized access or security breach. Accounts must be registered by a human; automated registration is not permitted.

Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:

  • break any applicable law or regulation;
  • send spam, unsolicited bulk messages, or any form of abusive or deceptive communication;
  • distribute malware, run exploits, operate command-and-control systems, or otherwise facilitate attacks on any system;
  • conduct port scanning, network probing, denial-of-service activity, or any other interference with systems or networks you do not own or have permission to test;
  • mine cryptocurrency or otherwise consume compute for the purpose of generating value unrelated to your scripts;
  • attempt to circumvent, or help others circumvent, the sandbox, its security controls, or any usage limit;
  • use the Service primarily to relay or forward network traffic on behalf of others, rather than to run your own scripts;
  • circumvent, or help others circumvent, another service's access controls, rate limits, or geographic restrictions;
  • attempt to gain unauthorized access to the Service, other accounts, or any connected system;
  • reverse engineer, decompile, or otherwise attempt to derive the source code or underlying infrastructure of the Service, except to the extent permitted by applicable law;
  • infringe the intellectual property, privacy, or other rights of any third party; or
  • place an unreasonable burden on our infrastructure or interfere with other users' use of the Service.

You are solely responsible for your scripts, the data they process, and the actions they take. You must have all necessary rights and permissions for any data or third-party service your scripts use.

Your Content

You keep all rights to the scripts, files, data, and other content you submit to the Service ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, transmit, run, back up, and otherwise process Your Content solely to operate and provide the Service to you. This license ends when you delete Your Content or close your account, except for copies kept in backups for a reasonable period and for records we must keep by law.

You are responsible for keeping your own copies of anything important. The Service is not a backup service.

Intellectual Property

The Service, including its software, design, and content (but not Your Content), is owned by GearTrain and its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service under these Terms, solely for your own use and only while these Terms apply. You may not copy, modify, distribute, sell, or lease any part of the Service, or use our name, logos, or branding (whether or not registered), without our prior written permission, except as permitted by applicable law.

Secrets and Credentials

You can store credentials as secrets. Secret values are stored securely and are write-only: after you save one, you can read its name but not its value. You are responsible for the third-party credentials you store and for how your scripts use them, including any costs your scripts incur with those third parties. Do not store secrets you are not authorized to use.

Limits and Fair Use

We currently offer a free plan. Plan limits (such as the number of jobs, runs per month, storage, and log retention) are described on our pricing page and may change over time. We run your scripts in a sandbox with limits on compute time, wall-clock time, memory, storage, and network use. These limits differ by plan and may change. We may throttle, delay, skip, or stop runs that exceed the limits or that we reasonably believe threaten the stability or security of the Service, and we may set fair-use limits to prevent disproportionate use.

The Service is currently free. We may charge for some or all of it in the future; before any charge applies to what you use, we will notify you, and you can stop using the Service if you would rather not pay.

No Safety-Critical Use

Do not use the Service where a failure or delay could cause injury, death, or significant physical, environmental, or financial harm. This includes medical, health, safety, emergency, and disaster-response uses.

Service Availability

We provide the Service "as is" and "as available". It may be unavailable from time to time for maintenance, updates, or reasons beyond our control. We do not currently offer any uptime guarantee.

Suspension and Termination

You may stop using the Service at any time and may close your account. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms, if your use poses a risk to the Service or to others, or if the law requires it. We may also change or discontinue the Service, in whole or in part, at any time.

When your access ends, your right to use the Service ends. We may delete your account and Your Content, subject to the retention described in our Privacy Policy and to any records we must keep by law.

Disclaimers

We provide the Service "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. This includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted, timely, secure, or error-free, or that it will meet your requirements or produce accurate results. You use the Service at your own risk, and we are not responsible for third-party services or content you access through your scripts.

Limitation of Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business, arising out of or relating to the Service, whether the claim is based on contract, tort (including negligence), or any other legal theory, even if we were told such damages were possible.

To the fullest extent the law allows, our total liability arising out of or relating to the Service will not exceed the greater of (a) what you paid us in the twelve months before the event giving rise to the claim, or (b) CHF 100.

Nothing in these Terms limits liability that cannot be limited under the law.

Indemnification

If a third party brings a claim arising from your use of the Service, your content, your scripts and what they do, or your breach of these Terms, you agree to defend us and cover the resulting losses and costs, including reasonable legal fees.

Reporting Abuse and Enforcement

We provide a platform for running scripts on a schedule. As part of that, the Service stores the files, data, and logs your scripts work with. We do not generally review or monitor the scripts you run or the content they process, but we prohibit the uses listed in the Acceptable Use section and will act on reports. If you believe the Service is being used for abuse or to infringe your rights, report it to [email protected] with enough detail for us to investigate.

We may investigate reports and may remove content, disable jobs, suspend accounts, or disclose information to law enforcement or other authorities where we believe it is necessary to prevent harm, to comply with a legal order, or as the law requires.

Changes to These Terms

We may update these Terms from time to time. If a change is material, we will make reasonable efforts to give you notice before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms. If you do not agree, stop using the Service.

Dispute Resolution

If a dispute arises out of or relates to these Terms or the Service, please contact us first at [email protected] so we can try to resolve it informally. If we cannot resolve it within a reasonable time, either party may bring the matter before the courts or other competent authority identified in the Governing Law and Jurisdiction section.

Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland, excluding its conflict-of-law rules and any rules that would refer the matter to another jurisdiction. The exclusive place of jurisdiction is the registered seat of the operator in Switzerland, subject to any mandatory provisions of applicable law.

If a court finds any part of these Terms unenforceable, the rest stays in effect. If we do not enforce a provision, that is not a waiver of it.

Assignment

You may not transfer these Terms or your account to anyone else without our written permission. We may transfer these Terms and our rights to a successor, for example in a merger or sale of assets.

Survival

Some provisions continue after these Terms end, including your indemnity obligations, the limits on our liability, our intellectual property rights, and the dispute-resolution and governing-law terms.
